TelecomRadar Terms of Service

§1 General Provisions
1. These Terms of Service set out the rules for using the TelecomRadar website, available at telecomradar.pl (hereinafter: the Service). 2. The owner and administrator of the Service is Miłosz Gołas (hereinafter: the Owner). You may contact the Owner via the contact form available at telecomradar.pl/kontakt. 3. The Service operates pursuant to the Polish Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2024, item 1513, consolidated text). 4. Use of the Service constitutes acceptance of these Terms of Service.
§2 Definitions
1. Service — the website available at telecomradar.pl, including all of its sub-pages. 2. User — any natural or legal person who uses the Service. 3. Operator — a telecommunications service provider whose offers are presented within the Service. 4. Operator Representative — a person authorized to accept orders on behalf of the Operator in accordance with its terms and service procedures. 5. Contact Form — a form available within the Service that enables the User to submit contact details to an Operator Representative. 6. Consumer — a User who is a natural person performing a legal act not directly related to their business or professional activity (Article 22¹ of the Polish Civil Code). 7. Entrepreneur with consumer rights — a natural person running a business who enters into a contract directly related to that business but not of a professional nature for them (Article 385⁵ of the Polish Civil Code). Consumer provisions apply to such a User.
§3 Type and Scope of Services
1. The Service provides the following electronic services, free of charge: a) comparison of fixed-line internet and television offers available in Poland, b) checking operator coverage at a specified address based on wholesale registry data, c) enabling contact with an Operator Representative via the Contact Form, d) publishing informational content (guides, articles) about the telecommunications market. 2. The Service does not currently engage in commercial activity. All services are provided free of charge to both Users and Operators. 3. The Service is not a party to any contracts concluded between the User and the Operator.
§4 Technical Requirements
1. To use the Service, the following are required: a) a device with internet access, b) a web browser in a current version (Chrome 111+, Firefox 111+, Safari 16.4+, Edge 111+), c) JavaScript and cookies enabled. 2. The Service is optimized for both mobile and desktop devices.
§5 Rules of Use
1. The User agrees to use the Service in accordance with its intended purpose, applicable law, and these Terms of Service. 2. The following activities are specifically prohibited: a) actions that may disrupt the functioning of the Service, b) use of automated tools for mass data extraction (scraping, bots), c) providing false information in forms, d) submitting unlawful content. 3. The Owner reserves the right to block access to the Service for any User who violates these Terms of Service.
§6 Contact Form and Data Transfer
1. Completing the Contact Form constitutes consent to share the provided data (first name, surname if given, phone number, email and address) with the selected telecommunications Operator for the purpose of presenting an offer. 2. Completing the form does not constitute entering into a contract with the Operator, nor does it create an obligation to purchase any service. 3. The Service forwards the User's contact data exclusively to the Representative of the Operator specified in the form. Only authorized Operator Representatives have access to this data, and they are required to process it solely for the purpose of handling the inquiry. 4. Data is processed in accordance with the Service's Privacy Policy.
§7 Prices and Offer Information
1. Information about offers, prices, promotions, and technical parameters presented in the Service is provided for informational purposes only and does not constitute a commercial offer within the meaning of Article 66 § 1 of the Polish Civil Code, but rather an invitation to conclude a contract within the meaning of Article 71 of the Civil Code. 2. Displayed prices may include discounts for e-invoicing and marketing consents, and may not account for certain surcharges (e.g., line maintenance fees). 3. The final terms of any contract, including the price, are determined directly between the User and the Operator. The Service is not liable for any discrepancies between the information in the Service and the Operator's actual offer. 4. The Owner makes every effort to ensure that the information presented is up to date; however, it does not guarantee its completeness or accuracy.
§8 Liability
1. The Service is not liable for: a) decisions made by the User based on information from the Service, b) the content or actions of telecommunications Operators, c) interruptions in the Service caused by technical issues or force majeure, d) damages resulting from improper use of the Service by the User. 2. The Owner is not liable for any actions taken by Operators after receiving User data through the Contact Form.
§9 Intellectual Property
1. All content published within the Service, including texts, graphics, page layout, software, and databases, constitutes the intellectual property of the Owner or is used under appropriate licenses. 2. Logos, names, and trademarks of telecommunications Operators displayed in the Service are the property of the respective entities. Their use within the Service is solely informational and serves to distinguish one Operator's services from another's. 3. Copying, distributing, or commercially exploiting the Service's content and data without the Owner's written consent is prohibited.
§10 Complaints
1. Complaints regarding the operation of the Service may be submitted via the contact form available at telecomradar.pl/kontakt. 2. A complaint should include a description of the issue and contact details to enable a response. 3. The Owner shall process the complaint within 30 days of receipt. 4. Complaints regarding services provided by telecommunications Operators should be directed to the relevant Operator.
§11 Out-of-Court Dispute Resolution
1. Consumers may use out-of-court means of handling complaints and pursuing claims, in particular: a) applying to a permanent consumer arbitration court operating at the Trade Inspection Authority, b) applying to the voivodeship inspector of the Trade Inspection Authority to initiate mediation proceedings, c) using the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr/.
§12 Personal Data
The rules for processing Users' personal data are set out in the Privacy Policy available within the Service. The Privacy Policy is an integral part of these Terms of Service.
§13 Changes to the Terms of Service
1. The Owner reserves the right to amend these Terms of Service. 2. Users will be notified of significant changes via a notice within the Service at least 14 days before the changes take effect. 3. Continued use of the Service after the changes take effect constitutes acceptance of the amended Terms of Service.
§14 Final Provisions
1. Matters not regulated by these Terms of Service shall be governed by Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services, and the Consumer Rights Act. 2. Disputes with Consumers shall be resolved by the court having jurisdiction under the Code of Civil Procedure (general or alternative jurisdiction at the Consumer's choice). 3. Disputes with Users who are not Consumers shall be resolved by the court having jurisdiction over the Owner's place of residence (Kraków, Poland). 4. These Terms of Service take effect on April 1, 2026.
